Copyright Basics Every Indian Songwriter Should Know

By Freqnc India Team · October 31, 2026

You spend hours writing a song, then share it with a producer or online. Who owns it? What stops someone from copying it? Copyright law can look scary, but the basic ideas are simple enough for every songwriter to learn.

What copyright protects

A song usually contains separate works. The lyrics are a literary work, the tune is a musical work, and the final recording is a sound recording. Different people can own these parts. A lyricist, composer and recording owner may be three separate parties.

What copyright does not protect

A general idea cannot be owned. Nobody owns the idea of a heartbreak song, a common chord progression or a simple phrase. Protection usually applies to your specific expression, such as your actual lyrics and melody.

Do you have to register?

In India, copyright generally arises automatically when an original work is created in a fixed form. Registration is not required for copyright to exist. However, it can be useful evidence in a dispute. The Copyright Office has an official process, and you should check its website for current forms and fees.

Keep proof of creation

The so-called "poor man's copyright", mailing a song to yourself, is not a replacement for proper records, but dated evidence can still help you.

Collaborations

When two people write a song, ownership can get confusing. Agree on shares in writing before release. Discuss what happens if one person wants to license the song later. Friendly conversations now prevent painful ones later.

Work for hire and paid work

If you pay someone to write, or someone pays you, the contract matters. Paying for a song does not always move all rights to the buyer. Make sure your agreement clearly states who owns the lyrics, music and recording, and how the song can be used.

What to do if someone copies you

  1. Stay calm and save evidence, including links and screenshots.
  2. Compare the works carefully. Similar style is not the same as copying.
  3. Check your proof of creation.
  4. Send a polite message, if appropriate.
  5. Use the platform's copyright reporting tool, if you have a real claim.
  6. Speak to a lawyer for serious cases.

Do not accidentally copy others

Melodies can stick in your head. Play new tunes to friends and ask if they remind them of another song. If a line or tune is clearly from another work, change it or get permission. Using lyrics from another song also needs care.

How long does protection last?

Copyright lasts for a long time. In India, the general period for literary and musical works is the author's lifetime plus 60 years, and sound recordings have their own term. Never assume that an old song is free to use.
